Is CBD Legal in the UK? Product Checks | CBD Armour

In the UK, CBD itself is not treated like controlled THC, but whether a product is lawful depends on the finished product, how it is marketed and its intended use category. This guide summarises the common product checks for shoppers. It is general information, not legal advice, and it does not replace official Home Office, FSA or MHRA guidance.

The Home Office’s cannabinoid licensing factsheet is the official starting point for controlled-drug questions. A seller’s use of “hemp” or “CBD” is not a legal assessment of a finished product.

What is the law on CBD in the UK?

In the UK, CBD (cannabidiol) itself is not a controlled drug in the same way as THC. That does not mean every product sold as “CBD” is automatically lawful. What matters is the finished product: its composition (especially other cannabinoids such as THC), how it is marketed, and the rules for its intended use (for example food supplement versus cosmetic versus prescribed medicine).

Oral CBD products sold as foods sit under food law, including the FSA’s Novel Foods framework for CBD. Sellers should be able to show clear product identity, ingredients, and — where provided — batch testing. Cosmetics follow cosmetic rules, not food rules. Prescribed cannabis-based products for medicinal use are a separate, tightly controlled category and are not the same as over-the-counter CBD oils or gummies.

Is cannabidiol legal in the UK?

Cannabidiol (CBD) is widely sold in the UK, and CBD as a substance is not treated like controlled THC. Legality still depends on the product, not the marketing name. A lawful CBD product should stay within applicable limits for controlled cannabinoids, match its stated category (food, cosmetic, or medicine), and not make unlawful medicinal claims.

Over-the-counter CBD oils, capsules, gummies and cosmetics are not the same as NHS-prescribed cannabis-based medicines. Flower, vapes, and high-THC products each raise different legal questions and should not be assumed legal because an oil is.

Before you buy, check the seller’s product information, intended use, and any lab results tied to that batch. For food-status questions, consult current FSA consumer advice and product listings. This answer summarises common checks for shoppers; it is not legal advice and does not determine the status of any one SKU.

Food supplement, cosmetic or prescribed medicine: which rules apply?

An oral oil, a cosmetic, a flower product and a prescribed medicine are not the same category. Check which rules apply to the actual item and its intended use:

  • Food supplements (oils, capsules or gummies taken by mouth) sit under food law, including the FSA’s Novel Foods framework for CBD.
  • Cosmetics (creams, balms, soaps and bath products) follow cosmetic rules, not food rules, and should not be sold as food or medicine.
  • Prescribed medicines are a separate, tightly controlled category. Medicines regulation sits with the MHRA, and retail CBD products are not medicines.

A statement about cultivation or one product type should not be reused as a blanket rule for everything sold under a CBD label.

Oral CBD and food status

For CBD sold as food, such as oils, capsules and gummies taken by mouth, consult the FSA CBD product list and read the status information carefully. Appearance on the list is not the same as product authorisation. Match the exact product and supplier details; a similar brand name does not settle the status of another item.

What information should a seller provide?

Look for a clear product identity, intended use, ingredient information and directions. Where laboratory evidence is supplied, check that it identifies the relevant product or batch and explains what was measured. A generic certificate without that connection cannot answer every question about the item in your basket.

Avoid treating a percentage printed in a marketing paragraph as a complete explanation of UK law. Ask what the figure measures and which official rule is being relied on.

Buying, driving and travelling are separate questions

Legal to buy is not the same as a drug-test result

Whether a product is legal to buy does not settle what a drug test will show. Most UK workplace tests are designed to detect THC rather than CBD, but some CBD products can contain trace THC, so no retailer can promise a test outcome.
