Is CBD legal in the UK? Check the product, not just the name

CBD itself is not a controlled drug, but that does not make every product marketed as CBD lawful. Other cannabinoids, the product’s composition and the rules for its intended use can change the answer.

The Home Office's cannabinoid licensing factsheet is the official starting point for controlled-drug questions. A seller’s use of “hemp” or “CBD” is not a legal assessment of a finished product.

Start with the product type

An oral oil, a cosmetic, a flower product and a prescribed medicine should not be treated as the same category. Check which rules apply to the actual item and its intended use. A statement about cultivation or one product type should not be reused as a blanket rule for everything sold under a CBD label.

Oral CBD and food status

For relevant food products, consult the FSA CBD product list and read the status information carefully. Appearance on the list is not the same as product authorisation. Match the exact product and supplier details; a similar brand name does not settle the status of another item.

What information should a seller provide?

Look for a clear product identity, intended use, ingredient information and directions. Where laboratory evidence is supplied, check that it identifies the relevant product or batch and explains what was measured. A generic certificate without that connection cannot answer every question about the item in your basket.

Avoid treating a percentage printed in a marketing paragraph as a complete explanation of UK law. Ask what the figure measures and which official rule is being relied on.

Buying, driving and travelling are separate questions
